It is a state company, incorporated as a limited company with variable capital. Its capital belongs to the Federal Government; it is regulated by the Federal Law of State Companies and its regulations. On July 1994 a Concession Agreement was awarded through the Ministry of Communications and Transportation according to the Mexican law, as recorded in deed no. 31, 157. The granting of the concession is aimed for the use, development and exploitation of property in the public domain of the federation, as well as the works and installations located in the port.

The general guidelines established which regulate the port activities of the API TUXPAN, are guidelines for growth and sustainability, as stipulated in the port legislation which is based on the order of the Master Development Plan.
